Welcome to Empower Adventure Operations Tampa Bay LLC dba Empower Adventures Tampa Bay (“EATB,” “Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website (zipontampabay.com), your booking of our services, and your participation in our text messaging programs. By accessing our website or booking an adventure, you agree to be bound by these Terms.

1. Booking & Eligibility

Age Requirements: You must be at least 18 years old to make a reservation through our website. If you are booking on behalf of minors, you represent that you are their parent, legal guardian, or have explicit authorization to book and sign waivers on their behalf.
Payment: Full payment or a required deposit is due at the time of booking. By providing a credit card or other payment method, you represent and warrant that you are authorized to use the designated payment method.

2. Activity Requirements & Safety

All outdoor recreation, including zip lining, paddleboarding, and aerial challenges, involves inherent risks. Safety is our top priority.

Physical Restrictions: Participants must meet our strictly enforced weight, age, and health requirements (as detailed on our FAQ and Activity pages).
Right to Refuse Service: EATB reserves the right to refuse service to anyone who, in the sole judgment of our staff, poses a safety risk to themselves, our guides, or other guests.
Zero Tolerance Policy: We enforce a strict zero-tolerance policy for drugs and alcohol. Anyone arriving under the influence will be turned away immediately and will forfeit their booking without a refund.
Dress Code: Closed-toe shoes are mandatory. Guests arriving in inappropriate footwear or clothing will not be permitted to participate.

3. Liability Waivers

Purchasing a ticket or making a reservation does not grant immediate access to our courses. All participants must read, agree to, and sign our official Assumption of Risk and Release of Liability Waiver prior to participating. Minors must have a waiver signed by their parent or legal guardian. Failure or refusal to sign the waiver will result in cancellation of your tour without a refund.

4. Cancellations, Late Arrivals & Weather Policy

Guest Cancellations & Late Arrivals: Because our tours have strictly limited capacities and depart on a set schedule, no-shows and late arrivals will not receive refunds. Please refer to our official Cancellation Policy page for specific timelines regarding rescheduling and cancellation fees.
Weather Disruptions: Our tours run rain or shine. However, for your safety, EATB reserves the right to delay, alter, or cancel tours due to extreme weather (including lightning, high winds, or severe storms). If EATB cancels your tour prior to completion due to weather, we will reschedule your group or issue a voucher/gift certificate for future use.

5. SMS / Text Messaging Terms

By providing your phone number and opting in to receive SMS text messages from EATB, you agree to the following:

Program Description: We utilize text messaging to send booking confirmations, weather updates, waiver reminders, and promotional offers.
Opting In: Consent to receive text messages is not required as a condition of purchasing any goods or services.
Message and Data Rates: Message and data rates may apply depending on your mobile carrier plan.
Message frequency varies.
Opting Out: You may opt out of receiving text messages at any time by replying STOP to any text message you receive from us. You will receive a single confirmation text that you have been opted out.
Help: Reply HELP to any of our text messages for assistance, or contact us at 813-448-5635.
Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages.

6. Media & Photo Release

By participating in our activities, you grant Empower Adventures Tampa Bay the right and permission to take photographs, video, and audio recordings of you and your minor children during the tour. You authorize EATB to use, reproduce, and publish these materials for promotional, marketing, and social media purposes without compensation or further notice.

7. Website Use & Intellectual Property

All content on zipontampabay.com, including logos, text, graphics, images, and videos, is the property of Empower Adventures Tampa Bay and is protected by copyright and trademark laws. You may not use, reproduce, scrape, or distribute any content from this site without our express written permission.

8. Disclaimers & Limitation of Liability

To the fullest extent permitted by applicable law, Empower Adventures Tampa Bay, its affiliates, directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of our website, errors or inaccuracies on the website, or your participation in our text messaging program.

9. Governing Law & Dispute Resolution

These Terms and your use of our website are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding related to this website or these Terms shall be brought exclusively in a state or federal court located in Pinellas County, Florida.
